NY conflicts rules apply. Lex loci delictus applies only to substantive matters under NY law; lex fori applies to procedural matters only. S/L is in between, as usual. NY has elaborate rules for S/L, most often applying the longer of its own S/L and the S/L of the place of the tort under NY's so-called borrowing statute.
